Terms of Service
Last updated 16 August 2026. Plain English, because terms nobody reads protect nobody.
These terms are the agreement between you and MyBotPlus ([insert registered entity name], "we", "us") covering your use of the mybotplus.com website, the dashboard, and the contact forms you build and publish with it. By creating an account you agree to them.
1. What we provide
A contact form builder with a hosted page, a website embed and a copyable HTML version; an inbox for what those forms collect; and a CRM, invoicing and income/expense tracker behind them. Our team will help you build and install your first form as part of the free setup assistance included on every plan.
Notifications and auto-replies from your forms are sent through the mail server you connect, from your own address. We do not relay them, we do not meter them, and if your mail server is unavailable those messages are not sent — the submissions themselves are still stored and shown in your account.
We aim for high availability but do not guarantee uninterrupted service on standard plans. Scheduled maintenance is announced in advance where possible. Enterprise agreements may include a specific SLA; standard plans do not.
2. Your account
- You must be at least 18 and able to enter a contract.
- You are responsible for keeping your password secure and for what happens under your account.
- You must give accurate signup information and keep it current.
- How many forms one account may have is set by your plan; submissions to those forms are unlimited on every plan.
- Tell us promptly if you believe your account has been accessed without your permission.
3. Your responsibilities for the people who fill in your forms
This is the part that matters most, so it is worth being direct.
- You are the controller of their data. You design the form and you decide what it asks for. We process what it collects on your instructions, as your processor.
- You are responsible for what your form asks. Publishing a form confirms that you have a lawful basis for collecting the information on it, and that you will use it for what you told the person you would.
- Tell them. Your own privacy policy should say what you collect, why, and how long you keep it. We give you the facts you need to write that; publishing it is your job.
- Do not collect regulated data. Do not build a form asking for payment card numbers, health records, government identifiers or similar special-category data. It is not built for that and we do not accept liability if you do it anyway.
4. Acceptable use
You may not use the service to:
- Break the law, or help anyone else do so.
- Send spam, or publish a form on a site you do not control.
- Impersonate another business, or build a form that appears to belong to one.
- Collect credentials, passwords or payment details through a form.
- Generate content that is hateful, harassing, deceptive, or sexual content involving minors.
- Attempt to extract our prompts, models or underlying systems, or to reverse engineer the service.
- Circumvent form limits, rate limits or domain restrictions.
- Run automated load against the service beyond normal use, or otherwise degrade it for others.
- Resell or white-label the service without a written agreement with us.
We may suspend an account that breaches this section. For anything other than serious or illegal misuse, we will tell you what the problem is and give you a chance to fix it first.
5. What the AI is, and is not
One feature uses an AI model: +Bot, the assistant in the corner of every signed-in screen, which turns an instruction you type into a contact, an invoice or a ledger entry. Your contact forms never involve a model at all. About +Bot:
- It can misread an instruction, particularly an ambiguous one. Everything it creates is shown to you before it matters, and everything is editable afterwards.
- It is not professional advice of any kind — legal, accounting, tax or otherwise. An invoice it produces is a document you are responsible for checking.
- You are responsible for reviewing what it records. Your books are your books.
- Typed commands are parsed by our own software rather than a model, and are free however often you use them.
6. Fees and billing
- The free trial runs 7 days and needs no card. It ends automatically; nothing is charged and there is nothing to cancel.
- Paid plans are billed in advance, monthly or yearly, at the price shown on the pricing page for your account's country.
- Submissions are unlimited and are never billed. +Bot AI messages beyond your monthly allowance draw on top-up credits at the published rate and appear on your next invoice.
- Prices exclude taxes unless stated. Where we must collect tax, it is added at checkout.
- Failed payment: we retry and email you. Persistent failure suspends the service; your data is retained for the period set out in the privacy policy.
- We may change prices with at least 30 days' notice by email. Existing paid periods are honoured at the old price.
7. Cancellation and refunds
Cancel any time from your dashboard. You keep access until the end of the period you have already paid for; we do not cut you off mid-month. Refunds are governed by the refund policy, which forms part of these terms.
8. Intellectual property
- Yours stays yours. Your forms, your submissions, your contacts, your invoices and your ledger belong to you. We claim no ownership.
- Ours stays ours. The software, the form runtime, the dashboard, our branding and our prompt engineering belong to us.
- You grant us a limited licence to process your content solely to provide the service. That licence ends when your account does.
- We may refer to you as a customer and use your logo in a customer list. Ask us not to and we will not.
9. Data protection
Our handling of personal data is set out in the privacy policy. Where we process the data of people who fill in your forms, we do so as your processor. If you need a formal Data Processing Agreement, ask and we will provide one.
We do not use your submissions or your business data to train public AI models, and we contract with our providers on terms that prohibit them from doing so with data we send.
10. Warranties
The service is provided "as is". To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the AI's answers will be accurate, complete or suitable for any particular purpose.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
11. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill or data.
Our total liability arising out of or relating to these terms is limited to the greater of (a) the fees you paid us in the 12 months before the claim arose, or (b) $120.
12. Indemnity
You will indemnify us against claims arising from your content, your use of the service in breach of these terms, or your failure to meet your own data protection obligations to the people who fill in your forms.
13. Termination
- You may close your account at any time.
- We may terminate for material breach, or immediately for illegal use.
- We may discontinue the service with 60 days' notice and a pro-rata refund of any prepaid unused period.
- On termination, export your leads. After the retention period in the privacy policy, data is deleted and cannot be recovered.
14. Changes to these terms
We may update these terms. Material changes are emailed to account holders at least 30 days in advance. Continuing to use the service after they take effect means you accept them; if you do not, cancel before that date and we will refund any unused prepaid period.
15. General
- These terms, the privacy policy and the refund policy are the entire agreement between us.
- If a clause is found unenforceable, the rest survives.
- Not enforcing a right once does not waive it.
- You may not assign this agreement without our consent; we may assign it as part of a merger or sale of the business.
